Media Policy

POWERQUIZ/TWINTIGER LLC. MEDIA AND PHOTOGRAPHY POLICY For School Trivia Competitions and Related Events

Governing Law: This Policy is governed by the laws of the State of Texas, United States.

POWERQUIZ/TWINTIGER LLC (collectively referred to as “we,” “us,” or “POWERQUIZ”) organizes and produces trivia competitions and related events at schools and school-affiliated venues. This Media and Photography Policy explains how photographs, videos, audio recordings, live streams, and other media (“Media”) are captured and used. By registering, attending, or participating in any POWERQUIZ/TWINTIGER LLC. event, you (and your parent or legal guardian if you are under 18) expressly acknowledge and agree to the terms below.

1. Media Capture

We, our authorized staff, contractors, photographers, videographers, media partners, and designated school representatives may photograph, film, videotape, record audio, live-stream, or otherwise capture still images, video footage, audio recordings, and any other form of Media depicting:

  • Event participants (students, teachers, staff, volunteers, and audience members);
  • Event activities, competitions, award ceremonies, and interactions;
  • The venue and surrounding areas during the event.

Media may be captured using professional cameras, smartphones, drones (where permitted), or any other technology. This includes both planned and candid photography and videography.

2. Rights Granted to POWERQUIZ/TWINTIGER LLC.

By attending or participating in the event, you irrevocably grant POWERQUIZ/TWINTIGER LLC. a worldwide, perpetual, royalty-free, sublicensable, transferable, and exclusive license to:

  • Use, reproduce, modify, edit, adapt, create derivative works from, distribute, publicly display, publicly perform, broadcast, transmit, publish, and otherwise exploit the Media in any form or medium now known or hereafter devised;
  • Use your name, likeness, voice, image, biographical information, and any statements you make in connection with the Media;
  • Incorporate the Media into promotional, advertising, marketing, educational, archival, or commercial materials, including (but not limited to):
    • Social media platforms (Instagram, Facebook, X/Twitter, TikTok, YouTube, etc.);
    • Television broadcasts, streaming services, or other media productions;
    • Websites, mobile apps, newsletters, press releases, and printed materials (brochures, posters, flyers, yearbooks, etc.);
    • Advertising and sponsorship materials;
    • Merchandise, digital downloads, or any other commercial product.

You waive any right to inspect or approve the finished Media or any use of it, and you waive any moral rights or “right of publicity” claims under Texas or federal law.

We reserve all media rights. POWERQUIZ/TWINTIGER LLC exclusively owns all copyrights, intellectual property rights, and other proprietary rights in the Media. No participant, attendee, school, or third party may reproduce, sell, distribute, or commercially exploit the Media without our prior written consent.

3. Consent and Minors

  • Adults: Your attendance and participation constitute your informed, voluntary consent to this Policy.
  • Minors (under 18): If you are a minor, your parent or legal guardian must consent on your behalf. By allowing a minor to register or attend a POWERQUIZ/TWINTIGER LLC. event (whether through school registration, parental consent forms, or event waivers), the parent/guardian confirms they have read and agreed to this Policy and authorize the capture and use of Media featuring the minor. Schools partnering with POWERQUIZ/TWINTIGER LLC. are responsible for ensuring appropriate parental consents are obtained in accordance with school district policies and FERPA (Family Educational Rights and Privacy Act).

4. Opt-Out / “Do Not Photograph” Procedure

We respect the privacy wishes of participants and families. If you (or your child) do not want to be photographed or videotaped:

  1. Notify us in advance by emailing [insert your official email, e.g., powerquiz@twintiger.org or contacting the event coordinator listed on the registration form at least 48 hours before the event.
  2. At the event, inform registration staff or a POWERQUIZ/TWINTIGER LLC team member immediately upon arrival. We may provide a visible “No Photo” badge or wristband or allot designated seats and make reasonable efforts to honor the request (e.g., avoiding close-up or identifiable shots of that individual).

Important limitations: In a live, multi-person event setting, it is not always possible to guarantee complete exclusion from every background shot, group photo, wide-angle video, or live stream. We will accommodate opt-out requests to the best of our ability, but we cannot guarantee that every image or video will exclude you entirely.

5. Privacy and Data Protection

  • We do not sell personal data or Media featuring identifiable individuals to third-party marketers.
  • Media containing personal information is handled in compliance with applicable U.S. privacy laws, including Texas privacy regulations and the Children’s Online Privacy Protection Act (COPPA) where relevant.
  • We may share Media with trusted media partners, sponsors, or schools for promotional purposes only, under confidentiality and usage restrictions.
  • You may request the removal of specific Media featuring you (or your minor child) by contacting us at the email below. We will review and remove publicly posted identifiable Media where feasible, but we are not required to remove Media already distributed in print, archived, or broadcast formats.

6. Third-Party and Attendee Media

This Policy applies only to Media captured by POWERQUIZ/TWINTIGER LLC or our authorized representatives. It does not restrict attendees, parents, students, or school staff from taking their own photos or videos for personal, non-commercial use. However, we encourage everyone to respect others’ privacy and obtain consent before posting images of minors or other individuals on social media.

7. Release and Limitation of Liability

To the fullest extent permitted by law, you (and your parent/guardian) release POWERQUIZ/TWINTIGER LLC, its officers, employees, contractors, sponsors, and partners from any and all claims, damages, or liabilities arising from:

  • The capture, use, or publication of Media under this Policy;
  • Any alteration, editing, or use of the Media;
  • Any incidental inclusion in background shots or live streams.

We are not responsible for any unauthorized use or re-publication of Media by third parties (including attendees or media outlets).

8. Changes to This Policy

We may update this Policy from time to time. The most current version will be posted on our website. Continued participation in future events constitutes acceptance of the revised Policy.
