These Terms of Use (“Terms”) govern your access to and use of powerquiz.com, the PowerQuiz mobile applications, physical trivia card products, corporate quiz compilations, digital downloads, newsletters, and all related services (collectively, the “Services”) operated by TwinTiger LLC (“TwinTiger,” “PowerQuiz,”  “we,” “us,” or “our”).

By accessing or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms as well as our Privacy Policy. If you do not agree, you must discontinue use of the Services.

1. Eligibility

  • The Services are designed for individuals ages three and older. Some content may require higher reading levels or parental assistance.
  • If you are under 18, you may use the Services only under the supervision of a parent or legal guardian who accepts these Terms on your behalf.
  • By using the Services, you represent that you have the legal capacity to enter into a binding agreement.

2. Account Registration

Some features—including leaderboards, digital purchases, stored progress, reward systems, and corporate portals—may require an account.

By creating an account, you agree to:

  • Provide accurate, complete, and up-to-date information.
  • Maintain the confidentiality of your login credentials.
  • Accept responsibility for all activity occurring under your account.

TwinTiger reserves the right to deny, suspend, or terminate accounts for violations of these Terms or suspicious activity. Unauthorized access should be reported immediately to powerquiz@twintiger.org.

3. Purchases, Pricing & Payment

3.1 General Purchasing Terms

  • All sales of physical card products, digital downloads, in-app purchases, and corporate licenses are final, unless required by Law or specified in our Refund Policy.
  • Orders may be cancelled by us for fraud prevention, stock shortages, inaccurate information, or other business-critical reasons.

3.2 Pricing & Currency

  • Prices are displayed in USD unless otherwise noted.
  • Prices may change at any time, including sales and promotional discounts.
  • Taxes and shipping charges may apply.

3.3 Payment Processing

We use secure third-party payment processors (such as Stripe, PayPal, Apple Pay, Google Pay). By submitting a payment, you:

  • Authorize the processor to charge your payment method.
  • Agree to comply with the processor’s terms and policies.

3.4 Corporate Licensing

Corporate customers may be required to sign a separate licensing agreement that overrides conflicting portions of these Terms.

4. License Granted to You

4.1 Physical Products

Upon delivery, you own the physical PowerQuiz cards; however, the intellectual property contained within them (questions, artwork, branding) remains our property.

4.2 Digital Products

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use digital content strictly for:

  • Personal, non-commercial use; or
  • Internal training/engagement use (for corporate license holders).

4.3 Restrictions

You must not:

  • Copy or scan trivia content.
  • Re-upload or redistribute questions.
  • Use content to build competing products.
  • Modify, reverse-engineer, or disassemble app or website components.

5. Prohibited Conduct

You agree not to engage in any activity that:

  • Violates laws or regulations.
  • Infringes intellectual property rights.
  • Attempts to hack, disrupt, or overload the Services.
  • Uses bots, scrapers, or unauthorized data collection tools.
  • Uploads malicious code or attempts unauthorized access.
  • Harasses or harms other users.
  • Misrepresents your identity.

Any violation may result in account termination and legal action.

6. Intellectual Property & Anti-Piracy

All PowerQuiz content—including trivia questions, illustrations, UI/UX design, app software, corporate decks, logos, and branding—is protected under U.S. and international copyright and trademark laws.

We strictly prohibit:

  • Copying, scanning, or reproducing card decks.
  • Reposting questions online.
  • Commercial exploitation without permission.

Enforcement Measures:

  • DMCA takedowns
  • Trademark enforcement
  • International anti-piracy monitoring
  • Legal action for damages, statutory penalties, or injunctions

7. User Content

You may submit content such as reviews, comments, usernames, profile pictures, or feedback. By posting or submitting content, you grant TwinTiger a worldwide, royalty-free, irrevocable, transferable, perpetual license to:

  • Display, distribute, reproduce, modify, adapt, or create derivative works from your content.
  • You represent that you own or have rights to any content you submit.

8. Termination

We may suspend or terminate your access to the Services at any time for:

  • Violating these Terms
  • Fraudulent or inappropriate behavior
  • Security risks
  • Extended account inactivity

Upon termination, all rights granted to you under these Terms will cease.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that:

  • The Services will be uninterrupted or error-free.
  • Content is always accurate or current.
  • The Services are free of viruses or harmful components.

10. Limitation of Liability

To the maximum extent permitted by Law:

  • TwinTiger LLC is not liable for indirect, incidental, special, punitive, or consequential damages.
  • Our total liability shall not exceed the greater of:
    1. The amount you paid in the last 12 months, OR
    2. $100 USD.

Some jurisdictions restrict limitation clauses; in such cases, the minimum legally required rights apply.

11. Indemnification

You agree to indemnify, defend, and hold harmless TwinTiger LLC from all claims, damages, losses, and expenses arising out of:

  • Your use or misuse of the Services
  • Your breach of these Terms
  • Your violation of third-party rights

12. Dispute Resolution – Arbitration & Class Action Waiver

12.1 Informal Resolution

Contact us at powerquiz@twintiger.org. We will attempt resolution within 30 days.

12.2 Binding Arbitration

Unresolved disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA) or similar service under its Consumer Arbitration Rules.

  • Conducted in a place decided by TwinTiger LLC or its affiliates, or via video conference.
  • Proceeding before one arbitrator.

12.3 No Class Actions

You may only bring disputes individually. Class, collective, or representative actions are strictly prohibited.

12.4 Waiver of Jury Trial

Both parties waive the right to a jury trial.

12.5 Exceptions

Either party may seek:

  • Small-claims relief
  • Injunctions to protect intellectual property or stop piracy

13. Governing Lawcurity

These Terms are governed by the laws of the State of Texas, without giving effect to conflict-of-law rules. All non-arbitrated disputes must be brought exclusively in Texas state or federal courts.

14. Changes to These Terms

We may revise these Terms at any time. The updated version will be posted with a revised “Last Updated” date. Continued use of the Services after changes constitutes acceptance.

15. Miscellaneous

  • Entire Agreement: These Terms + Privacy Policy constitute the full agreement.
  • Severability: Invalid provisions do not affect the remainder.
  • No Waiver: Failure to enforce rights is not a waiver.
  • Assignment: We may assign these Terms; users may not assign without written consent.
